The landlord has applied for termination of the tenancy for breach of the tenant’s obligations. The tenancy agreement does not allow for the tenant to keep a pet without first obtaining the approval of the landlord. No such approval has been given.

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

The landlord provided evidence that the dog remained at the premises as recently as Friday 12 September 2025. The tenant did not dispute that the dog was still living at the premises.

It would be inequitable to refuse to terminate the tenancy because of the tenant’s longstanding failure to comply with the tenancy agreement by having a dog. The issue was initially raised with the tenant by the landlord in November 2024.

The landlord says that the premises are not suitable for a dog. The premises are one of four units in a complex. There is no green space or fencing at the complex. The neighbours have complained about the presence of the dog.

I have no doubt that the dog is loved and well cared for by the tenant. The tenant has made extensive efforts to try and rehome the dog. Unfortunately, those efforts have not been successful.

The tenant is given until 5pm on Tuesday 7 October 2025 to rehome the dog. If the tenant fails to rehome the dog by that time, then the tenancy will be terminated at 5.00 pm on Tuesday 14 October 2025 and possession returned to the landlord.

The tenant applied for name suppression. The tenant has not been wholly or substantially successful in this hearing and the application for name suppression is dismissed.
