The tenants, Tiaese Livi Tapumanaia and Michael Elborn Taufa, owe Street Smart Property Management Limited As Agent For Homemax Ltd the sum of $7,698.00 (“the debt”), comprising rental arrears up to 25 August 2025 and reimbursement of the Tribunal filing fee, detailed as follows:

Tiaese Livi Tapumanaia and Michael Elborn Taufa must pay both the ongoing rent and the above debt as follows: a. Rent of $620.00 every week, due every Friday; and b. An additional $920.00 every fortnight, starting Friday, 5 September 2025, toward repayment of the debt until paid.

If the tenants fail to pay either the rent or the debt repayment within two working days of the due dates: a. The tenancy at 11 Elvira Place, Ranui, Auckland 0612 will terminate, and the landlord will be entitled to immediate possession of the premises; and b. Any outstanding balance of the debt will become immediately payable in full.

Reasons

The landlord attended the hearing. Tenant Tiaese Livi Tapumanaia was also present and advised the Tribunal that the other tenant, Michael Elborn Taufa, could not attend due to work commitments. However, she confirmed he was aware of the hearing and had authorised her to speak on his behalf. The hearing proceeded in his absence accordingly.

The landlord presented rent records which clearly established the arrears. These were accepted by the tenant.

The landlord initially applied for termination of the tenancy, recovery of rent arrears, and refund of the bond. The tenant expressed a desire to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

As the rent was more than 21 days in arrears at the time the application was filed, the Tribunal is required under section 55(1)(a) and (1A) of the Residential Tenancies Act 1986 to issue either a final or a conditional termination order.

Ms Tapumanaia explained that the rent arrears resulted from changes in income and difficulty obtaining employment. She apologised and advised that she and her co-tenant have both now secured employment, which will allow them to realistically repay the debt over approximately eight weeks.

Although the landlord expressed concern over prior failed arrangements – including a rent reduction that still led to arrears – they agreed to offer one final opportunity for the tenants to remain in the property under a conditional termination order, provided the repayment terms are strictly followed.

The implications of a conditional order were explained to Ms Tapumanaia, and she confirmed her full understanding. She also confirmed the proposed payment plan is achievable: a. Weekly rent of $620.00 paid every Friday; and b. Plus, an additional $920.00 paid fortnightly towards the debt, comprising: i. $620.00 from both tenants together; and ii. $300.00 from Mr Taufa every alternate fortnight.

The $920.00 may be paid in partial amounts across the fortnight, provided the full amount is received by the due date. The landlord accepted this arrangement, conditional on it being supported by a consequential termination provision for any missed payment.

Given the agreement between the parties and the payment plan, I am satisfied that the tenants are likely to meet their obligations and repay the debt within the specified timeframe. I therefore grant a conditional termination order.

If the tenants fully comply with the terms of this order, the conditional termination will lapse and the tenancy may continue. However, if any breach occurs, the possession order may be enforced within 90 days of the first breach, in accordance with section 64(4)(b) of the Residential Tenancies Act 1986. Filing fee
