The tenant must remove all dogs from the premises by 4.pm on Wednesday 22 October 2025 and ensure that no dogs are kept at the premises without the prior consent of the landlord.

This matter is determined as indicated by the order above, but the landlord is granted a period of three months within which, if the tenant fails to remove the dog or there are further instances of dogs being kept at the premises without the prior consent of the landlord, the landlord can request that the application be brought back before to the Tribunal and the matter will be re-opened.

Reasons

Both parties attended the video hearing on 8 October 2025.

The landlord seeks an order from the Tribunal requiring the tenant to remove the dog (“George”) being kept at the premises, without the landlords consent, in breach of the tenancy agreement.

Clause 19 of the tenancy agreement between the parties provides; “you must let us know if you want to keep a pet, including a dog. We will allow you to keep pet(s) on the premises as long as the pet(s) meet the guidelines explained in the Appendix “Can I keep a pet”. This forms part of the terms of this agreement.”

The appendix sets out the matters the landlord will take into account before it consents to a pet including; How suitable the home is for a pet; Whether the pet is likely to attack any person other pet; Whether it will cause a nuisance to neighbours or damage the premises; and, if the pet is a dog that it is not specified as a dangerous or menacing dog under the dog Control Act 1996.

The landlord provided evidence, that was not disputed by the tenant, that the landlord discovered an American Staffordshire Terrier dog residing at the premises in March 2025.

The landlord provided the tenant with the appropriate forms to seek consent for the pet to reside at the premises.

The forms have never been completed or returned by the tenant.

The landlord subsequently received a complaint on 22 April 2025 from neighbours that the dog was roaming and chasing people.

Based on its behaviour, the dog was deemed not to be suitable by the landlord. The tenant was advised of this.

A 14 day notice to remove the dog was served on the tenant. The notice was dated 28 April 2025 and gave the tenant through to the 19 May 2025 to remove the dog. A check was made of the premises by the landlord on the 19 May 2025. The dog was still at the premises.

On 18 July 2025, the landlord received a complaint from the council that the dog had been roaming. The council said that as the dog had been roaming, had not been desexed, it was classified as a menacing breed.

The tenant said that she had experienced difficulty in rehoming the dog.

At the hearing today, the landlord confirmed that the dog was present at the premises as recently as Monday 6 October 2025 when the most recent check was carried out.

I accept on the evidence that the dog is being kept at the premises without consent and must be removed. Orders are made accordingly pursuant to s. 77(2)(m) Residential Tenancies Act 1986.

I informed the parties during the hearing that if the tenant does not comply with the Tribunal’s order, the landlord may within three months of the date of this order, apply for termination of the tenancy, for breach of the tenants obligations under the tenancy agreement concerning the keeping of pets.

The tenant applied for name suppression. The tenant has not been wholly or substantially successful in this hearing. The tenants application for name suppression is dismissed.
