An application for suppression has been made in this case, and the Tribunal orders suppression of the tenant’s name and identifying details.
[The tenant/s] must pay Waikare Land Holdings Limited $1,678.00 immediately, as set out below

Reasons

Both parties attended the hearing.
The landlord has applied for rent arrears.
The tenant disputes that the rent arrears are owing. He acknowledges that on 21/7/2025 he signed and returned a written tenancy agreement confirming that the tenancy was to start from 31/7. He considers that he had a right to cancel the contract before 31/7 without having to pay any rent in lieu of notice.
On 25 July his mother had an accident, and he needed to relocate north to assist her with recuperating from her injuries. He messaged asking if he could cancel the agreement. The landlord said he could cancel but would be liable for 21 days rent.
The tenant asked his local Citizens Advise Bureau for advice and was told that he could cancel the contract as it had not yet started.
The applicant filed the claim for 21 days rent in lieu of notice and confirmed that the premises had been readvertised on Trade Me as soon as the contract was cancelled but the new tenancy did not begin until well after 21 August.
I find the parties had a signed contract (the evidence is clear that there was an offer to rent, an acceptance of that offer and valuable consideration in the form of the agreed weekly rent). The tenant was therefore required to give 21 days’ notice to end the tenancy and is liable for rent for that notice period. The only exception would be if a new tenancy began earlier than 21 days after the notice was given but that does not apply here. I am also satisfied that the landlord took immediate steps to mitigate the loss by readvertising once the notice was given. There can therefore be no suggestion that the landlord has failed to mitigate (or reduce the loss).
The rent in lieu of notice is therefore owing as awarded.
Because Waikare Land Holdings Limited has wholly succeeded with the claim I must reimburse the filing fee.
I have approved the tenant’s request for name suppression as I am satisfied that he has only defended the application because of legal advice he received that said he could cancel without incurring a rent liability. He has entitled to test that advice without fear of any potential negative implications from having his name published.
The suppression order is made because the Tribunal is also satisfied that the tenant will now take steps to pay what he owes to put an end to this matter.
