An application for suppression has been made in this case, and the Tribunal orders suppression of both parties’ name and identifying details.
The tenancy of [The tenant/s] at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], at 11.59pm on Friday 10 October 2025.
[The tenant/s] must pay [The landlord/s] $19,576.57 immediately, calculated as shown in the table below:

Reasons

The landlord and the tenant are brothers. The tenancy premises is the property that they grew up in. In 2009 after their mother passed away, the landlord purchased the house. The landlord and the tenant entered into a tenancy agreement whereby the tenant paid $400 per week in rent. The rent would be paid fortnightly.
Since April 2023 the tenant has been on and off in rent arrears. The tenant has paid no rent at all since the 25 March this year.
On the 31 March the landlord gave the tenant a 90 day notice to end the tenancy on the 30 June 2025. The landlord says that this is because the house needs renovating, and the landlord is considering a sale after renovation.
The tenant denies receiving the 90 days’ notice even though it was sent to his usual email address.
In any case, I do not consider that I need to enquire into the 90-day notice as the landlord has asked for termination on the basis that at the date of application the tenant was more than 21 days in rent arrears. I am satisfied that the tenant was more than 21 days in rent arrears as at the date of the landlord’s application (30 July 2025) and therefore I must terminate the tenancy.
The landlord provided me with a rent ledger which proves the rent owing.
The tenancy is terminated as of next Friday which will allow the tenant some time to leave the property. Rent is calculated as owing up until that date.
The tenant does not dispute that he has not paid rent since March, or the amount of rent arrears. He says that he has stopped paying rent because the house is in need of repair and maintenance which has not been done, he also says that he has had large water bills because of leaks at the property.
The tenant has not filed a claim for compensation in respect of those items and has not issued 14 day notices or demand for the landlord. I do not consider that there is likely to be a set off that will extinguish the rent owed.
Because [The applicant/s] has substantially succeeded with the claim I have reimbursed the filing fee.
As this involves a family dispute, I have decided that the private family interests outweigh the public interest and to suppress the parties’ names and identifying details.
