Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

In early July 2025 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. They were notified by the tenant’s partner that he had been arrested and placed into custody. The tenant stated during the hearing that he is reliant on this tenancy as a bail address. He says that he is guaranteed bail when he next appears on 9 September 2025.

The landlord seeks termination and possession on the basis that the tenant has not resided at the tenancy address for a significant period of time. The landlord further states that because of this they must have possession returned to enable them to provide housing for others who require it.

I am satisfied that an order for termination and possession is appropriate.

Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice.

The landlord has applied for rent arrears and has provided rent records which prove the amount owing. Having sighted the landlord’s rent ledger I am satisfied that the tenant is responsible for the rent debt.

The landlord does not seek reimbursement of the filing fee.

The landlord seeks name suppression on behalf of the tenant. Given the tenant’s custodial status I am satisfied that an order for name suppression is appropriate.

I do not see any public interest in having the tenant’s name released on this occasion. The decision will still be published with the tenant’s name redacted and I consider that this satisfies the need for open justice.
