The landlord’s application included a request for the bond to be paid. However the bond was refunded to the landlord following the order of the Tribunal, application XXXXX18, dated X 2025. Rent arrears
The landlord has applied for rent arrears at the end of the tenancy. However there were no additional rent arrears during the tenancy following the order of the Tribunal, application XXXXX18, dated X 2025. Therefore that order covers all the arrears due at the end of the tenancy but does not include a rent credit of $37.50 due to the tenant which the landlord applied on 30 June 2025.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. The lawns and gardens required over 22 hours of work. There was a cost to remove clippings and weeds to the tip.
The amounts claimed have been proved.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for. See section 49B(1) RTA.
The order of the Tribunal, application XXXXX18, dated X 2025, the Tribunal recorded methamphetamine residue readings as follows: a. Dining Room 25ug/100cm2 b. Hallway 62μg/100cm2 c. Bathroom 17.4μg/100cm2 d. Bedroom 26μg/100cm2 e. Lounge 36μg/100cm2 f. Kitchen 210μg/100cm2.
The landlord has incurred decontamination costs, removal and replacement of carpet and curtains resulting from the tenant’s use of methamphetamine.

The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
The total loss the landlord suffered from this tenancy exceeded $35,000.00. The landlord has reduced that claim to $12,000.00. I have considered the evidence and am satisfied that the amount claimed is reasonable and generous to the tenant. Filing fee
Because the landlord has been partly successful with the claim the filing fee of $28.00 is ordered to be paid by the tenant. Suppression
The landlord has applied for name suppression. Section 95A(1) of the Residential Tenancies Act 1986 provides that the Tribunal must, on the application of a party that has wholly or substantially succeeded in proceedings, order that the party’s name or identifying particulars not be published, unless the Tribunal considers that publication is in the public interest or is justified because of the party’s conduct or any other circumstances of the case.
