Reasons

A hearing was convened on 19 August 2025 by video conference. The landlord attended. The tenant did not attend, and although the Tribunal also attempted to contact the tenant by phone, this was unsuccessful. I am satisfied that the hearing notice was adequately served. It was therefore reasonable to proceed with the hearing in the tenant’s absence.

The landlord has applied for termination of the tenancy on two grounds: for abandonment and breach of the tenant’s obligations. The landlord also claimed rent arrears and refund of the bond.

Should the tenancy be terminated?

Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) of the Residential Tenancies Act 1986 (the Act).

Additionally, section 61 of the Act permits termination if the Tribunal is satisfied that the premises have been abandoned, provided that rent is in arrears at the hearing date.

The landlord’s evidence is that rent is at least 21 days in arrears at the date of the hearing.

The landlord also presented a detailed chronology of events showing that by 1 August 2025, the premises had been abandoned. This included: • Rent ceased in early July 2025 and is now more than 21 days in arrears. • The tenant has not responded to repeated calls, emails, or formal breach notices. • The tenant’s mother advised that she had not heard from her son for weeks and believed he had relocated to Auckland with an ex-partner. • Inspections on 21 July and 1 August revealed that, key personal items such as clothing, toiletries, food, and electronic chargers were absent. • A 14-day breach notice and subsequent first warning notice were ignored.

Taken together, these facts demonstrate a clear abandonment: the tenant has ceased to meet obligations, removed personal items, failed to communicate, and given no indication of return. Unlike a temporary absence, there is no evidence of continued intention to occupy or pay rent.

Accordingly, the tenancy is therefore terminated.

As the landlord has wholly succeeded with the claim, I must order the tenant to reimburse the filing fee and grant suppression of the landlord’s name and identifying details.
