Reasons
- This was a telephone hearing. The cell phone number for the landlord failed but they were eventually contacted via the call centre. The tenant was called three times on the phone number provided but did not answer. The hearing continued in their absence.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond and reimbursement of the filing fee.
- The landlord stated that they had tried many avenues to contact and engage the tenant but had no success. They sought a conditional termination but without the tenant present to agree to terms this order could not be made.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided up to date rent records which prove the amount owing at the date of the application and at end of the tenancy.
- Because Te Ahuru Mowai Limited Partnership has wholly succeeded with the claim I must reimburse the filing fee.
