[The tenant/s] must pay rent and the debt as follows: a. By weekly payments of rent of $660.00 to be paid on Wednesday each week. (Due dates 29 October, 5 November and 12 November 2025) b. A final payment of $2,488.00 on 12 November 2025 for the debt.

Payments will be allocated in the following order: rent, rent arrears, and the filing fee.

If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Both parties attended the hearing.

This is a tenancy of some six years. Over the past year the tenant has had some personal difficulties.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

The landlord also wishes to conduct an inspection of the property as this is a requirement of the landlord’s insurance as it has been over 3 months since the last inspection was done.

The tenant says that she has applied for alternative housing and is working with state agencies to try and obtain another place to live.

The landlord wants the rent brought up to date and the tenant to pay the full rent weekly. The landlord also wants to conduct an inspection. If the tenant can pay her rent arrears and allows an inspection then the landlord is willing to continue with the tenancy.

The tenant wishes to pay the rent owed and allow an inspection to avoid termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

I have ordered the landlord to conduct an inspection of the property, the landlord is entitled to inspect the property. The landlord has only agreed to a conditional termination order on the basis that the tenant allows this inspection. Therefore, if the tenant does not allow the inspection to take place the landlord can ask the tribunal to make an immediate termination order and I will do so. The tenant should be aware that she MUST allow the landlord to conduct an inspection at 10am on Friday 24 October 2025.
