Reasons

Both parties attended the hearing by telephone.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

The tenant claims to have access to funds from a family trust. He says that the rent can be paid in full within 24 hours and no further breach is likely as he will set up a direct payment to the landlord (via MSD).

The rent summary shows that rent payments have been sporadic. No rent has been paid for 7 weeks. The funds should have been arranged and regular rent payments established before the hearing today.

However, the landlord was prepared to allow the tenant a final opportunity to pay the arrears. As such I have made a conditional termination order for payment in full within 48 hours, as promised by the tenant.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

Once the lump payment has been made, rent will be due every Wednesday, with the first payment to be made on 15 October 2025. I would expect the tenant to have set up the weekly payments before that date.

As the landlord was the successful party, I have also awarded reimbursement of the Tribunal filing fee and granted its request for suppression of it details.

The tenant also applied for suppression, citing health reasons (both his own and his father’s). In this instance, I consider that the tenant’s interests marginally outweigh the public interest in the open reporting of justice and have granted suppression. See s95A RTA.
