Reasons

Ms McArthur appeared by video for the landlord. The tenants did not join the hearing. Attempts to contact them on the numbers provided in the application were unsuccessful, and the matter proceeded in their absence.

The tenancy commenced on 02 March 2023 and is current. On 28 July 2025, the landlord issued the tenants with a 14-day notice to remedy rent arrears by 11 August 2025. The rent summary provided shows that the tenant was in rent arrears at the material time and that they failed to comply with the notice. On 14 August 2025, the landlord filed a claim seeking termination of the tenancy.

Should the tenancy be terminated?

Where a landlord applies to terminate for breach of a 14-day notice issued for rent arrears, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) of the Residential Tenancies Act 1986 (Act).

In this case, the tenant failed to remedy the breach notice, and the rent is at least 21 days in arrears at the hearing date.

The landlord is a social housing provider and invites the Tribunal to consider making a conditional order.

The landlord outlined the tenant’s personal circumstances, stating that one of them is employed, the other is not currently working, and that they have a young child.

Section 55(1A) of the Act provides that the Tribunal may, instead of making a final order, make a conditional termination order if it is satisfied the tenant will repay the arrears within a specified period and that a similar breach is unlikely to occur again.

Having considered the material before the Tribunal and the landlord’s evidence, I am satisfied that it is appropriate to make a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) of the Act.

The landlord has been substantially successful, and I order reimbursement of the filing fee.

Under section 95A of the Act, the Tribunal must, unless there are reasons not to, order suppression of the name and details of any party who has been wholly or substantially successful. Although entitled to name suppression, the landlord does not seek it. The landlord also opposes suppression for the tenants, submitting while they have avoided immediate termination, they have not been sufficiently successful.

Section 95A (4) provides the Tribunal with discretion to suppress the name and details of a party who has not been wholly or substantially successful. Having considered the tenants’ personal circumstances and noting that they have avoided immediate termination, I am satisfied that there are grounds to exercise the discretion, and the Tribunal orders suppression of the tenant’s name.
