- Samantha Boreham must pay Christine Boyce and Silia Stringfellow $13,306.57 immediately, calculated as shown in table below.
Reasons
- Mrs Boyce attended the hearing for the landlord. The tenant did not attend. The hearing was held by video.
- The landlord applied for termination of the tenancy and rent arrears. This matter was first considered at a hearing held on 14 November 2025 which both parties attended. On 17 November 2025 the Tribunal issued an order terminating the tenancy for rent arrears.
- The matter was adjourned to enable the landlord to provide further evidence on rent arrears owed.
- At the initial hearing the tenant raised matter’s concerning Mrs Stringfellow’s behaviour, as set out in my earlier order on this matter. The tenant was given the opportunity to file an application in the Tribunal if she wanted her claim determined at the same time as the landlord’s application for rent arrears.
- The tenant did not file the claim within the time frame provided (by 5.00pm on 8 December 2025) and accordingly the landlord’s rent arrears application was set down for determination. As I stated in my previous order, failure to file an application within the time frame specified does not prevent the tenant from filing an application at a later date.
How much is owed for rent ?
- The tenancy was terminated on 23 November 2025. However the tenant had not moved out by that date. The tenant is liable for rent to the end of the day on 24 November 2025 as she remained in occupation of the premises at that time.
- The tenant raised at the last hearing that she had made 9 payments of $650.00 during the tenancy. The tenant has not provided any evidence to support this. The landlord provided rent records and bank statements which prove the amount owing at the end of the tenancy.
Was any bond paid by the tenant?
- The tenant said at the hearing on 14 November 2025 that she had personally paid bond to the Bond Centre. I addressed in my earlier order that I was not convinced this had occurred as it is for the landlord to forward rent to the Bond Centre.
- I find there is no evidence that the tenant paid any bond to the landlord or the Bond Centre. Other matters
- The landlord raised that rubbish and goods belonging to the tenant were left at the premises at the end of the tenancy. This issue was not determined under the landlord’s application as the landlord had not amended the claim to include compensation for removal of rubbish.
- Filing Fee: As the landlord wholly succeeded with the claim I must reimburse the filing fee.
