[The landlord’s representative] explained that rent payments have not been made regularly for some time, and that the arrears have reached a point where they are no longer manageable. He said that mediation had been attempted but was unsuccessful. He also described several discussions he had with Ms Wood about moving out, noting that she had already been given three weeks to do so, but nothing had changed. He said he was not confident she would move even if given more time.

[The landlord’s representative] also mentioned that there had been disturbances at the property involving a person Ms Wood had living with her, which had led to police involvement. He said he was not comfortable allowing that person back into the house and was concerned about the impact on neighbouring tenants.

Ms Wood told me that she had agreed in a phone call to pay rent and some arrears each week, but that the person who moved in to share costs never paid anything. She said she received just over $500 per week and cannot afford the rent on her own. She said she has had difficulty finding someone reliable who the landlord will also accept as a flatmate. Ms Wood said she plans to move out and can do so within about two weeks. She also mentioned an upcoming appointment with WINZ to get help with storage and moving costs.

I accept that Ms Wood has had a difficult time, and it is unfortunate that her situation has worsened due to circumstances partly beyond her control. However, the arrears are significant and ongoing, and the evidence before me does not give me confidence that she is able to keep up with rent payments or reduce the arrears.

I have considered the possibility of making a conditional termination order. However, I am not satisfied that Ms Wood can pay her weekly rent or her rent arrears.

Accordingly, the tenancy is terminated, and possession is granted to [The landlord/s] at 11.59 p.m. on Wednesday, 15 October 2025.
