Reasons

Both parties attended the hearing which was conducted remotely.
The landlord applied for termination for rent arrears, but at the date of the hearing, the tenancy had ended by consent. However, the landlord says that the tenants still owe 10 weeks of rent. They produced a rent summary showing that between 3 April and 5 June, no payments were made.
The tenants dispute that they owe any rent.
The onus of proof is on the landlord to prove their claim. The standard of proof is on the balance of probabilities.
When the landlords took possession of the premises, the tenants were already living there. The tenancy continued under a verbal agreement. Rent was paid into a bank account from 1 August 2024 until 27 March 2025.
In June 2025 the landlord realised that the tenants had stopped paying rent. Payments resumed on 12 June 2025, this time in cash. There is no dispute that payments continued until the tenancy terminated on 31 August 2025. The landlords say that they are owed $2,500 in rent arrears.
The tenants say that in March 2025 they started paying the rent in cash at the request of the landlords. They deny any missed payments.
The landlords say that it was the tenants who wanted to pay the rent in cash and that was after the bank payments had stopped.
There are no receipts for rent paid as required by section 29 of the Act.
On 22 January 2025, the landlord had purportedly given notice to terminate the tenancy on 31 July 2025.
On 11 July 2025 the landlord issued a further termination notice saying: This letter serves as further notice to confirm the extended termination as per our discussion of the tenancy, and the vacation of above address by 4pm Monday 4th August 2025. ... If the property is vacated by this time, we will forego the 10 weeks arrears ($2500.00). By failing to vacate by this time we will proceed as advised with legal action to reclaim the arrears.
The tenants did not respond.
I have decided that it is more likely than not that the tenants missed 10 weeks of rent. I find it plausible that the landlords did not notice the bank transfers had stopped. The have acknowledged that some payments were made in cash and so there is no reason to say that the other 10 weeks were not paid in cash. They recorded the debt in a termination notice on 11 July and there is no recorded denial.
Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
