The landlord attended the hearing which was held via a video link. The tenant did not join the video link at the start of the hearing., I called the tenant on the cell phone number recorded on the application twice at the start of the hearing. Both calls went to voicemail.

The landlord has applied for termination of the tenancy for abandonment, rent arrears, an order to dispose of the goods and refund of the bond. The landlord’s termination application was originally for rent arrears and then updated the application to termination for abandonment.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 11 September 2025 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord had carried out an inspection and thought the tenancy was abandoned. The landlord then learned from neighbours that the tenant had left and advised them he was not coming back.

Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes three weeks rent in lieu of notice from the date the landlord found the tenancy was abandoned. 7. Disposal of goods

As explained to the landlord at the hearing, the Tribunal does not need to make an order that the landlord can dispose of goods in the circumstances that apply here. If the landlord has made all reasonable efforts to contact the tenant and agree on a period within the tenant is to collect their goods, and the tenant does not collect the goods within that period or the landlord is unable to contact the tenant, then the landlord may deal with the goods (other than personal goods) by making all reasonable efforts to assess the market value of the goods (see section 62 Residential Tenancies Act 1986 (RTA)).

If the goods indicates any of the goods have a market value that is less than the cost of storing, transporting and selling the goods then the landlord is able dispose of those goods in any way the landlord thinks is fit (see section 62A(1) RTA).

As the landlord has wholly succeeded with the claim I must reimburse the filing fee.
