This application was scheduled to be heard by video conference. Mr Cherrington did not link to the Teams link provided to him and so the hearing proceeded in his absence.
The landlord has applied for termination of the tenancy for abandonment, rent arrears, reimbursement of the filing fee and payment of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 19 August 2025 the landlord became aware, after a few visits to the premises, that the tenant had abandoned the premises. Food was untouched as were belongings and notices left by the landlord.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing to 9 September 2025. This amount includes three weeks’ notice of termination that a tenant is meant to give a landlord, starting from the date on which the landlord knew the tenancy had been abandoned – ie 3 weeks from 19 August 2025.
Further to this I am ordering the tenant to reimburse the filing fee to the landlord because the landlord was wholly successful with the claim against him. C ter Haar 17 September 2025
