Should the tenancy be terminated?

The landlord filed their application on 3 September 2025. Rent arrears were $4,427.00 (54 days) on this date. Because rent was more than 21 days in arrears on the date the application was filed, I must terminate the tenancy.

I consider this to be an appropriate case to make a conditional order for termination, rather than a final order. This is because rent arrears have reduced by $910.00 since the landlord filed their application. The tenant has been paying their rent on time, plus an additional $130.00 towards the arrears since 28 August 2025. These factors convince me on the balance of probabilities that the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. 1

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. 2

I accept the landlord’s rent summary as accurate and grant their claim for rent arrears for $3,517.00. 1 Residential Tenancies Act 1986, section 55(1A). 2 Residential Tenancies Act 1986, section 64(4)(b). Filing fee and name suppression

The landlord made an application not to recover the filing fee and therefore, I do not order the tenant to reimburse it.

The landlord sought name suppression on behalf of the tenant. I have a discretion to grant the tenant name suppression under section 95A(4) RTA. This section requires me to consider the interests of the parties and public. In Lewis v Wilson & Horton [2003] 3 NZLR 546 at paragraph 43, The Court of Appeal endorsed the approach taken in the High Court, which held: ...that the principle of open justice dictates that there should be no restriction on publication of information about a case ‘except in very special circumstances.’

There is a strong public interest in ensuring prospective landlords are able to determine the credit worthiness of prospective tenants when considering whether to rent premises to them in the future. The fact that publication of the tenant’s name in this decision might deter prospective landlords because of the tenant’s history of rent arrears is not exceptional or extraordinary. These proceedings are standard and the decision does not refer to any sensitive information in relation to the tenant. For these reasons, I find the public’s interest in publication outweighs the tenant’s interest in name suppression.

I decline to order suppression of the tenant’s name and identifying details.
