The tenancy of Jovarn Darwin at Unit/Flat Flat 56, 3 Bannister Avenue, Johnsonville, Wellington 6037, Heath Flats is terminated, and possession is granted to Te Toi Mahana, at 11:59pm on Sunday 2 November 2025.
The Bond Centre is to pay the bond of $300.00 (BN-00010641) to Te Toi Mahana immediately.
Jovarn Darwin must pay Te Toi Mahana $670.86 immediately, calculated as shown in the table below:

Reasons

The landlord attended the hearing represented by Ms Weber.
Mr Darwin did not attend the video hearing and did not answer the calls made to his phone during the hearing. Whilst he may be incarcerated, he had been notified of the hearing by email and text on his personal email and the corrections email address, and therefore did have the hearing link.
Accordingly, I am satisfied on the evidence I have that Mr Darwin did have opportunity to attend the hearing. Therefore, pursuant to section 92 of the Residential Tenancies Act 1986 (RTA) the hearing continued in his absence.
I have however allowed several days before the tenancy is to end to enable Mr Darwin to take the required steps if he had wanted to attend the hearing but had not been able to.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The grounds the landlord seeks termination are on the basis of rent arrears and that Mr Darwin assaulted another tenant of the social housing complex.
The evidence establishes that Mr Darwin’s rent was at least 21 days in arrears on the date the application was filed and is well in excess of that now. Further, that he has been charged with offences of violence where the victim was a neighbouring tenant he was in a relationship with.
I am satisfied on the basis of the evidence I have that the tenancy must be terminated. See sections 55(1)(a) and (c)(v) of the Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
Because Te Toi Mahana has wholly succeeded with the claim I must reimburse the filing fee.
