Reasons

[The landlord’s representative] , attended the teleconference hearing. The tenant attended the hearing briefly, confirmed she had already left the property, had withdrawn from the tenancy due to family violence, and hoped the bond could be applied to any rent arrears. The tenant then said her daughter was having urgent dental work and so then hung up.

There were originally two tenants in the tenancy. However, the landlord advised during the hearing that the other tenant left the tenancy, effective 3 September 2025, with the landlord’s written consent. Therefore, the landlord said the tenant who left the tenancy should not have been included in the application and asked that their name be removed, which I do so, as the tenant left the tenancy before the landlord made the application.

The landlord has applied for termination of the tenancy, rent arrears, refund of the bond and reimbursement of the filing fee.

The landlord indicated that, despite the tenant applying to withdraw from the tenancy pursuant to the family violence provisions, she had not provided sufficiently completed paperwork to them to qualify for this withdrawal from the tenancy.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

As the tenant confirmed she had already left the property anyway, when she briefly attended the hearing, the termination of the tenancy is immediate, to mitigate any further loss for both the landlord and for the tenant.
