Reasons

The hearing was held by teleconference today. The landlord attended the hearing. Shortly before the scheduled hearing, the Tribunal received an email from the tenant stating: “I’m currently in the middle of shifting house still and with movers etc so won’t be free for 3.30 – I may be by 4 pm sorry.”
It is clear from this message that the tenant was aware of the date and time of the hearing but chose to prioritise other matters. No formal request to adjourn the hearing was made, nor were any reasons provided that might justify a delay. In the circumstances and given the urgent nature of the application, I considered it reasonable and in the interests of justice to proceed with the hearing in the tenant’s absence.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
The landlord produced a rent summary showing that as at 13 September 2025— the date the application was filed—the rent arrears were $1,934.28. This exceeds the statutory threshold under section 55(1)(a), which provides that the Tribunal must terminate the tenancy if, at the time of the application, rent was at least 21 days in arrears. The landlord also confirmed that the arrears have since increased to $3,794.28 as at today’s date.
I am satisfied, on the evidence before me, that the landlord has established their claim. The tenancy is therefore terminated immediately, and possession of the premises is granted to the landlord.
As the landlord has been wholly successful with the claim, I must order the tenant to reimburse the filing fee.
