[The party] and [The party] are keeping at least three dogs on the property they rent from Kāinga Ora–Homes And Communities, in breach of clause 30 of the Tenancy Agreement they signed with Housing New Zealand Corporation in 2013.

[The party] and [The party] must remove all dogs and puppies from 388 Swanson Road, Ranui, Auckland 0612 by 5:00pm on Monday 12 January 2026.

If the tenants fail to remove all dogs and puppies from 388 Swanson Road, Ranui, Auckland 0612 by 5:00pm on Monday 12 January 2026, the tenancy will terminate, and the landlord will have immediate possession of the premises.

Reasons

Should a conditional termination order be made?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so. See section 56(1) Residential Tenancies Act 1986.

On 1, 9, 12 May 2025, the landlord advised the tenants they are not allowed any unapproved dogs in their tenancy, without completing a ‘Pet Information Sheet’ and getting written consent from Kainga Ora. The tenants have not completed this form, nor have they been given approval to keep dogs at the premise.

On 1 August 2025. the landlord served a 14-day notice on the tenants’ but the breach was not remedied within the required period. Therefore, the tenants breached their obligations by failing to remove all unapproved dogs from the premise by 19 August 2025. It would be inequitable to refuse to terminate the tenancy because the tenancy agreement contained a no unapproved pet clause because the premise is not deemed suitable for large or medium sized dogs.

The male tenant stated during the hearing that the tenants refuse to recognise Kāinga Ora–Homes And Communities as their landlord, as they have never received a new tenancy agreement from it, nor have they seen a transfer of tenancy letter from it or Housing New Zealand Corporation. Additionally, they refuse to recognise the landlord’s representative without seeing legal and written authority. The tenants have been dealing with Tangi Tuaivi and did not want to deal with a new representative they do not know and have not dealt with before.

I note that in 2019, Housing New Zealand Corporation, HLC, and Kiwibuild merged to form Kāinga Ora Homes and Communities with expanded responsibilities: to: a. Manage the public housing portfolio; b. Lead government urban development projects; c. Provide homeownership support to first home buyers; and d. Deliver key government housing initiatives.

All Housing New Zealand Corporation tenancy agreements were automatically transferred to the new public housing portfolio agency, being Kāinga Ora Homes and Communities. No new tenancy agreements were deemed necessary as it was a change in agency name only. The rest of the original terms and conditions set out in the Housing New Zealand Corporation tenancy agreements still applied to the tenancies managed by the new agency name.

Kāinga Ora Homes and Communities representative at today’s hearing has authority to act for it in Tribunal hearings by nature of the role she holds within the organisation.

The conditional termination order will lapse if it is fully complied with. If the tenants breach the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
