Reasons

The hearing proceeded by teleconference. The landlord attended. The tenants did not. The Tribunal attempted to contact the tenants on the numbers provided in the application but without success. I am satisfied that proper service of the hearing notice was effected, and it is reasonable to proceed in the tenants’ absence.
The landlord filed this application on 16 September 2025 seeking rent arrears of $1,050.00 and unpaid water charges of $341.83.
A tenant must pay rent as and when it falls due and is responsible for water charges incurred during the tenancy on the basis of consumption (see sections 40 and 39 Residential Tenancies Act 1986 (“RTA”)).
At the hearing, the landlord provided an update confirming that the tenants have since paid all rent arrears outstanding. Although the landlord noted another rent payment will be due again this week. As the Tribunal cannot order payment of rent that is not yet due or arrears that have since been remedied, no order is made in respect of rent.
The landlord also confirmed that the tenants have made payment towards the water account, leaving a remaining balance of $103.00. Based on the landlord’s documentation, I am satisfied that $103.00 remains owing and order that amount.
The landlord expressed concern that this is the second application they have been required to file in relation to arrears arising under this tenancy. The Tribunal acknowledges that concern. It is burdensome, time-consuming, and often costly for landlords to pursue arrears through repeated formal applications. While the Tribunal must decide only the matters properly before it, the landlord’s position is understandable in light of the payment history produced.
The Tribunal sounds a clear note of caution to the tenants. The rent ledger shows a persistent pattern of late or irregular payment of both rent and water charges. Persisting in this pattern is hazardous. Repeated failures to pay outgoings on time may well lead the Tribunal, upon a future application, to issue more significant orders, including termination under sections 55 or 56 of the Act if the statutory tests are met. The tenants are strongly encouraged to ensure that all future payments are made promptly and consistently.
Under section 102 RTA, the landlord has been substantially successful in recovering the outstanding water charges and therefore I must order the tenants to reimburse the filing fee.
