The landlord attended the hearing. The tenant did not attend and couldn’t be reached on the number given on the Notice of Hearing, which awas properly served.
The landlord has applied for compensation and reimbursement of the filing fee following the end of the tenancy.
The tenancy was ended on 4 June 2025 by an Order of the Tribunal made on that date (application 5270920. The bond was paid to the landlord under that Order.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.
The evidence provided by the landlord and given by the property manager proves on balance that the premises were not left reasonably clean and tidy and the tenant did not remove all rubbish. The tenant did not return the keys provided.
The landlord has provided invoices proving the cost of cleaning (1/2 of the cleaning charges paid by the owner) rubbish removal and having locks replaced. The tenant should compensate the landlord for those costs.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent (or four weeks' market rent in the case of a tenant paying income-related rent). See section 49B(3)(a) RTA.
The following damage was caused during the tenancy: a. a towel rail, coat hook and ceiling light were broken; b. door handles and window lathees were broken c. there were holes in several doors which needed to be repaired and the pantry door needed to be rehung d. the bathroom vanity was damaged and needed to be replaced, the shower was broken and needed to be replaced (only compensation for the installation not the new shower itself is claimed) e. there was damage to many of the cladding panels on the garage.
Photographic evidence and the evidence of the property manager who inspected the premises during the tenancy, satisfy me that the damage is more than fair wear and tear and occurred during the tenancy. The tenant has not disproved liability for the damage.
The landlord has provided invoices for the costs incurred in completing that repair work, which prove the landlord’s loss.
The owner’s insurers have accepted a claim for the garage damage so that claim is now limited to the excess paid by the owner on that claim.
The vanity and garage were new at the start of the tenancy so not allowance for betterment or depreciation needs to be made.
Because [The applicant/s] has succeeded with the claim I must reimburse the filing fee.
