If the tenant fails to comply with either Order 1 or 2 above, the landlord may undertake the work and charge the tenant the costs of this work up to $250.00. These costs may be treated as rent in arrears and enforced accordingly.

Reasons

Ms Gray attended the hearing on behalf of the landlord. The tenant was rung at two phone numbers provided by the landlord. There was no answer at either number.

The landlord claims that the tenant has not kept the carpet clean and has drawn or allowed drawing on the walls. The landlord wants the problem fixed.

The landlord wrote to the tenant on 18 July 2025 notifying the tenant that she was in breach of her obligations. She was given 14 days to fix this. Ms Gray said that a housing officer arranged a visit to the home yesterday, but the tenant was not home. Looking through the windows, the breaches had not been remedied.

Under section 40(1)(c) of the Residential Tenancies Act 1986, a tenant must keep the premises reasonably clean and tidy. Under section 40(2), a tenant must not intentionally or carelessly damage, or permit any other person to damage, the premises.

Where the Tribunal finds the tenant has failed to comply with any of these obligations, where appropriate it may make an order for the tenant to carry out the work. See section 78(1)(e).

Therefore the tenant is ordered to deep clean the carpets, removing all food residue and clean the drawings off the walls.

Because the work order is not being made by consent of both parties, the Tribunal must also make a monetary order as an alternative to compliance with the work order. See section 78(2).

A work order may also authorise the landlord to undertake the work and charge the tenant the costs of doing the work, if the tenant should fail to comply with the work order and alternative monetary order. A monetary limit must be imposed by the Tribunal on the amount of costs that can be charged. These costs can be treated as rent in arrears and enforced accordingly. See sections 78(2AAB) and 78(2AAC)(a) Residential Tenancies Act 1986.

The landlord agrees that the tenant may have another month to have the carpets cleaned and to clean the walls.

If the tenant fails to comply with the order to clean the carpet and walls by 15 December then the landlord may undertake the work and charge the tenant up to $250. That is made up of $150 for carpet cleaning and $100 for the drawings on the walls.

If the tenant would rather the landlord undertook the work, then she can pay $250 immediately for the landlord to take care of it.

The tenant is reminded that if she continues to breach her obligations as a tenant, the landlord may apply for a termination under section 56 of the Act. The Tribunal may terminated the tenancy if it finds it would be inequitable to refuse to terminate.
