The tenancy ended in October 2025. By that time, the Tenant was behind in the rent. She had been unwell and hospitalised. The Landlord has now applied to recover rent arrears on $4,282.86 and the $28 filing fee. Rent arrears
The Landlord has provided a rent summary that shows rent arrears of $4,282.86 at the end of the tenancy. During the hearing, the Tenant disputed that amount on three grounds.
First, she said that the rent records did not take account of the two weeks’ rent she paid in advance at the start of the tenant. The Landlord produced a spreadsheet covering all payments between 23 April 2025 to 23 September 2025. I have assessed the Landlord’s rent records and they do account for those payments. They are the first two payments recorded on those rent records.
Second, the Tenant said that the rent records did not record a payment made by her parents on her behalf. Again, the Landlord’s rent records do account for that payment and show that a payment of $1,830 was made on 31 August 2025.
Third, the Tenant said that WINZ made a rent payment of $1,970 directly to the Landlord, which is not reflected on the rent summary. The Landlord says that no such payment was made. I therefore asked the Tenant to provide evidence that this payment was made. After the hearing, the Tenant (through her support person) advised the Tribunal that the payment was made for storage, not rent.
The Landlord has therefore proven that there are rent arrears of $4,282.86 and I order that the Tenant must pay that amount to the Landlord. Filing fee and name suppression
The Landlord has been successful in its claim, so it is entitled to recover the filing fee and to name suppression. I also order name suppression for the Tenant.
The Landlord opposed name suppression for the Tenant on the grounds that other landlords are entitled to know the identity of tenants who fail to pay the rent. I understand that submission. However, in this case I consider that the Tenant’s personal circumstances justify suppression. She is 28 weeks’ pregnant. I am told that doctors consider the pregnancy to be high risk due to underlying health conditions. Publication of her name may exacerbate her health conditions and cause further risk to her pregnancy. That is not in the public interest. I therefore order suppression of the Tenant’s name and identifying details. The bond
I order that the Bond Centre is to release the bond of $1,830 to the Landlord.
