Both parties attended the hearing by telephone.
The tenant sought an adjournment of the hearing because he had only received notice of the hearing on 3 October 2025 and had not been able to do anything about making arrangements to have the outstanding rent paid.
I declined the request for an adjournment because the tenant has had an adequate period of notice of the hearing. The rent is some 20 weeks in arrears. Seeking further time to arrange payment is not grounds for an adjournment.
The landlord has applied for termination of the tenancy, rent arrears, water rates, electricity and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent, water rates and power records which prove the amount owing at the end of the tenancy.
The landlord applied for the disposal of the tenant’s goods. The tenant had given the landlord authority under a written letter to dispose of the goods. He indicated at the hearing that he had reconsidered the matter.
It is not practicable for the landlord to the return the goods to the tenant. The value of the goods is below the cost of storing, transporting and selling them. Therefore the landlord may dispose of the goods. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.
