Reasons
- The landlord attended the hearing by phone call.
- The tenant was telephoned on the phone number provided but the phone call went to voice mail. I am satisfied the tenant was properly served with notice of the hearing. The hearing proceeded in his absence.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986. Given the level of rent arrears I have not delayed the termination date.
- The landlord provided rent records which prove the amount owing as at 15 December 2025. Rent arrears was only claimed to this date.
- The bond is to be paid to the landlord immediately to offset the rent arrears.
- Because the landlord has wholly succeeded with the claim, I must reimburse the filing fee.
- The landlord did not seek name suppression.
- The landlord has a claim for outgoings, which could not be determined at this hearing as the claim was not included in the application form. The landlord may file this claim at a later date.
