The landlord attended the hearing by telephone today. I telephoned the tenant however his phone did not connect.

I continued with the hearing in the tenant’s absence because he has been emailed notice of the hearing to his address for service together with a link to allow him to participate by video conference.

The tenant has sent a written submission which I have read and taken into account.

The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The landlord says that the tenant gave notice to end the tenancy and the end date was agreed to be 4 September 2025. The tenant then asked if he could remain until 9 September 2025, but this was declined as the rent was in arrears.

The tenant’s submission says that he returned the keys to the agent’s drop-box on 4 September 2025 and texted the property manager to let her know. He has not supplied a copy of this text. The property manager was present at the hearing and says she did not receive this text. The evidence includes an email dated 9 September 2025 at 8.55am from the staff member who clears the drop- box to the property manager which says: “3c RmD Rostrevor keys back & in cupboard”.

My decision is that the evidence supports the landlord’s evidence that the keys were returned early on 9 September 2025. I award rent up to and including 8 September 2025.

The landlord provided rent records which prove the amount owing to 9 September 2025 is $1,040.00. I deduct one day of rent and award $1,002.86.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The landlord says the tenant did not leave the premises reasonably clean and tidy. After reviewing the photos, I do not agree with the landlord. There is a little bit of residue here and there but overall, the premises are reasonably clean. I dismiss this claim.

The landlord says a TV was missing from the tenant’s room at the end of the tenancy. The tenant says in his submission that there was no TV in his room at the start of the tenancy and that he texted the property manager about this at the time. He did not supply a copy of this text.

The property manager confirmed she was the person who conducted the start of tenancy inspection and took a photo showing a TV sitting on top of two bedside tables the day before this tenancy started. She provided the photo, and I accept her evidence.

The tenancy agreement records all chattels provided with the tenancy and includes a TV and TV remote.

I am satisfied there was a TV at the start and that it was missing at the end of the tenancy.

The landlord supplied an invoice for the cost to replace a TV of the same size and quality. It is $339.00 plus $19.00 for delivery.

The Tribunal usually takes into account the age and condition of damaged or missing items so that the landlord is compensated for the value of what they lost and is not better or worse off.

The property manager told me she replaced the TV in this room about a year ago. The Inland Revenue Department publishes a guide estimating the expected useful life of various common tenancy chattels. 1 A television is estimated to last 5 years. I therefore depreciate the replacement cost of the TV by 20% and award the landlord $271.20 plus $19.00 delivery which is $290.20.

The landlord is substantially successful so I award the filing fee.

The bond is refunded to the landlord and the balance is owing by the tenant.

No suppression orders apply.
