I first started hearing this application on 28 October 2025 at which time the landlord had applied for termination under section 59 of the Residential Tenancies Act 1986 (RTA) because it considered that the premises were uninhabitable due to significant methamphetamine contamination.

I adjourned the hearing and sought submissions from the landlord addressing the decision of the High Court in Nisbet v Te Āhuru Mōwai Ltd Partnership 1 . That decision has changed the way in which the Tribunal deals with applications for termination under section 59 RTA.

The landlord provided further submissions as requested.

Since then, the landlord inspected the premises on 12 November 2025 and has issued 2 14-day breach notices on the tenant. That timeframe has not yet expired.

I earlier allowed the landlord to amend its application up to 7 days before today’s hearing if it considered there were other grounds on which to terminate the tenancy.

The landlord applied to amend the application, seeking termination under section 55 RTA within the time I allowed.

The photos produced in evidence from the 12 November inspection show that the tenant has caused, or has permitted another person to cause, substantial damage to the premises.

In addition to the high levels of methamphetamine contamination in several areas of the house – between 30.9 μg/100cm² and 94.7 μg/100cm² – the premises now appear to have been trashed. There is graffiti sprayed on internal walls and the premises have been ransacked.

Section 55(1)(b) RTA requires the Tribunal to make an order terminating the tenancy if the Tribunal is satisfied that the tenant has caused, or has permitted any other person to cause, or has threatened to cause, substantial damage to the premises.

The photographic and other evidence the landlord has produced satisfies the Tribunal that the section 55(1)(b) RTA requirements are met. The tenancy is therefore terminated with immediate effect since it is unlikely that the tenant is even living there.
