Reasons

The landlord attended the hearing which was held by video conference. The tenant did not attend. The Tribunal attempted to contact the tenant on the contact number provided in the application but without success. I am satisfied that proper service of the hearing notice has been completed and considered it appropriate to proceed with the hearing.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
The evidence presented satisfies the Tribunal that the premises were abandoned as of 30 September 2025, or at the very least, the landlord became aware or ought reasonably to have become aware by that date that the tenant no longer occupied the premises.
The landlord says the tenant abandoned the property and left it in a significantly damaged condition. A routine inspection carried out on 1 September 2025 revealed several concerning findings. The tenant had painted over the walls and timber flooring in the entrance hallway without the landlord’s knowledge or consent, despite the property being recently redecorated at the start of the tenancy. Staining—believed to be paint—was found on the carpet in a bedroom, which will require professional deep cleaning. Additional physical damage was noted to walls, locks throughout the premises were broken, and all smoke alarms had been removed—creating not only a breach of tenant obligations but a serious safety issue.
There was no visible evidence that the property was currently occupied, and the landlord reports that neighbours confirmed they had not seen the tenant in some time. These observations support the conclusion that the tenant had vacated the premises without notifying the landlord and had no intention to return.
As the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.
