Mr Singh appeared for the landlord by telephone. An unsuccessful attempt was made to contact the tenant on the phone number provided, and the matter has proceeded in their absence.

The tenancy commenced on 21 September 2022 and is current. On 1 October 2025, the landlord filed a claim seeking termination of the tenancy for failing to remedy a fourteen-day breach notice for rent arrears and water rates. Law

The Tribunal may terminate a tenancy for breach where due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986 (Act).

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

Under section 39 of the Act, the tenant is responsible for outgoings that are exclusively attributable to their occupation of the premises, such as electricity, gas, telephone, and water charges (if separately metered). Decision

The updated rent summary shows that the tenant remedied the rent arrears with a lump sum payment on 24 November 2025, and as of today is one week in advance.

Although the tenant did not remedy the notice within 14 days, the arrears have been cleared, and I am not satisfied it would be inequitable to refuse termination. The application for termination for rent arrears is dismissed.

The landlord has provided water and wastewater rates invoices for the period 6 May 2025 to 6 November 2025. The landlord has also provided a statement showing that the tenant has made payments towards the rates. The amount claimed and awarded is that which is outstanding.

The claim is based on usage only and does not include fixed charges, for which the tenant is not liable. Costs

Under section 102(4)(a) of the Act, if a party has been wholly successful, the Tribunal must order reimbursement of the filing fee. However, if the party has been only partly successful, the Tribunal has discretion under subsection (4)(b) as to whether to order reimbursement.

The landlord has not been wholly successful, and I decline to order reimbursement of the filing fee. Name suppression

Section 95A of the Act provides that on the application of a party that has been wholly or substantially successful in proceedings, the Tribunal must order that the name or identifying particulars not be published, unless the Tribunal considers that it is in the public interest to publish the names of the parties, or is justified because of the parties’ conduct, or any other circumstances of the case.

The tenant has been substantially successful in these proceedings and the Tribunal orders suppression of their name. The landlord does not seek suppression.
