- The landlord attended the hearing via remote video conference. There was no attendance by the tenant. An attempt to contact the tenant on the telephone number provided was unsuccessful.
- The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
How much is owed for rent and electricity charges?
- The tenancy ended on 9 January 2026. The landlord provided rent records which prove the amount owing at the end of the tenancy. The landlord also provided an updated rent ledger prior to the hearing. Having sighted the landlord’s updated rent ledger I am satisfied that the tenant is responsible for the outstanding rent debt.
- The landlord also claims for an electrician’s call out fee. The landlord says that the premises had no hot water because of a tenant turning off the hot water cylinder by mistake. All tenants were required to share the cost of the callout. The landlord also provided an invoice in the tenant’s name and an invoice from Pronto Electrical dated 24 November 2025 confirming the callout fee.

Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
- The tenant did not return the electronic key fob, the front door key and the bedroom door key. The landlord will need to have these replaced before new tenants can move in. This will be a direct cost to the landlord.
- The claim for key replacement is established.
- Because Team Property Management Limited As Agent For Mike & Jenny Stewart And Ferguson has wholly succeeded with the claim I must reimburse the filing fee.
