In the absence of such a provision, a tenant may, at any time during the tenancy, sublet or otherwise part with possession of the premises with the prior written consent of the landlord and in accordance with any conditions attached to that consent. 3 Analysis

The tenancy began on 11 July 2025 and was for a fixed term ending on 4 December 2025.

In late September 2025, the tenant requested to end the tenancy early. The landlord agreed, provided the tenant paid rent until a new tenancy began, and paid $370.00 for advertising and administration costs. These conditions are standard for requests of this nature.

The landlord advertised the premises for rent after receiving the tenant’s request to end the tenancy early however, they have been unable to tenant the premises. The landlord gave evidence that a lot of their tenants are international students and because it is the end of the academic year, it is harder to find a replacement tenant. 1 Residential Tenancies Act 1986, section 92. 2 Residential Tenancies Act 1986, section 40(1)(a) 3 Residential Tenancies Act 1986, section 44(1) and (2).

The landlord submitted a copy of the TradeMe advertisement for the premises. I am satisfied the landlord has taken reasonable steps to try to mitigate their loss by advertising the premises for rent.

Because this was a fixed-term tenancy, the tenant must pay rent until the end of the fixed term or until a new tenancy begins, whichever occurs first. In this case, a new tenancy did not begin before the end of the fixed term. Therefore, the tenant must pay rent up to and including, 4 December 2025. The landlord submitted a rent summary, which records rent arrears as being $2,585.00 up to this date.
