- The Bond Centre is to pay the bond of $650.00 (6378599-002) to Rent Wise Property Management Limited immediately.
- Joshua Willemse and Dashiell Lemon must pay Rent Wise Property Management Limited $6,195.14 immediately, calculated as shown in the table below:

Reasons
- Both parties attended the hearing which was held by teleconference. The tenants were represented by Mr Willemse.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed.
- The landlord has provided rent records proving the amount owed which, at the date of the hearing, equates to the rent being 110 days in arrears.
- Mr Willemse says the arrears have accumulated during a time when he was not well and asks for 2 weeks to access his KiwiSaver fund or family support to pay off the arrears in full.
- I discussed with the parties at length the possibility of an Order being made to allow the tenants an opportunity to fully pay the rent arrears, with provisions to make sure that that the rent arrears would not increase in the meantime. That would seem to be in both parties’ interests.
- The landlord is adamant that the tenancy should be terminated.
- I have considered whether a conditional termination Order should be made under s.55(1A) despite the landlord’s opposition.
- Given the extent of the arrears and the somewhat erratic rent payment history, the evidence does not enable me to be satisfied the tenants will pay the arrears within a reasonable period or that any further breaches are unlikely.
- I must therefore make an Order terminating the tenancy. See section 55(1)(a) Residential Tenancies Act 1986.
- Because Rent Wise Property Management Limited has succeeded with the claim I must reimburse the filing fee.
- The tenants seek suppression but the grounds are not established 1 .
