Reasons
- On 15 April 2026 I issued my decision on these applications. I dismissed the tenants’ application for non-appearance. I made an order against the tenants on the landlord’s application for $21,046.40.
- After the hearing, the landlord advised the Tribunal that they had made an error. The owner’s insurer had accepted an insurance claim for the cost of methamphetamine testing and remediation.
- The landlord amended their claim to the amount of the insurance excess for the methamphetamine testing and remediation - $2,500.00.
- Because the Tribunal had not made any error (its decision was based on the evidence presented and the submissions made), I could not issue an addendum or a corrigendum. I invited an application for rehearing.
- The landlord completed an application for rehearing. I have accepted that and have granted a rehearing on the papers.
- For the reasons set out in the Tribunal’s order (except for paragraph 17) the landlord’s claim for methamphetamine testing and remediation is proved, but the amount awarded is limited to the amount of the owner’s insurance excess, as sought by the landlord. The claim for rent arrears is likewise proved, and the filing fee is awarded.
- When a rehearing is granted, the previous order falls away and cannot be enforced.
- This order is now the enforceable order on the landlord’s application.
