A final payment of $1,378.00, being $1,125.00 for rent and $253.00 for the debt. c. Payments will be every Saturday, with the first payment on 22/11/2025 and continuing until 18/04/2026.

Reasons

Both parties attended the remote hearing.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

Section 55(1)(a) Residential Tenancies Act 1986 allows the Tribunal to terminate a tenancy where rent is at least 21 days in arrears on the date the application was filed. The landlord provided a rent summary which shows the balance of rent arrears on 10 October 2025, when the application was filed, was $2,350.00. That is less than the equivalent of 21 days in arrears. The application under s.55(1)(a) RTA is dismissed.

Should the tenancy be terminated?

The landlord applied for leave to amend their application for termination to an application under s.56 RTA. Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.

Rent is at least 21 days in arrears at the hearing date. The landlord provided records that the rent is in arrears today in the sum of $5,875.00, the tenant having paid $1,175.00 today. Arrears will be $7,050.00 tomorrow.

Should a conditional termination order be made?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. The amount of rent arrears means that it would be inequitable to refuse to terminate the tenancy.

Despite my finding that it would be inequitable to refuse to terminate the tenancy, having heard the evidence, I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further breach. I have granted a conditional termination. See section 78(3) Residential Tenancies Act 1986.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

The tenant raised issues with the terms of the tenancy agreement at the hearing. That tenancy agreement was entered into in February 2025. No evidence was provided by the tenant to substantiate the claim and I have disregarded it for the purposes of this hearing.

As New Era Property Management Limited As Agent For M Gaba has wholly succeeded with the claim I must order the tenant to reimburse the filing fee.

The tenant applied for name suppression. The tenant has not been wholly or substantially successful in this matter and the tenant’s application is dismissed.
