The landlord attended the hearing, set down to be conducted via video conference. There was no entry into the conference by the tenant, nor any prior contact with the Registry. A call to the tenant was attempted but unsuccessful. I was satisfied adequate service had completed and I continued with the hearing after the call went unanswered.

The landlord has applied for compensation, outgoings, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

The tenancy ended on 21 August 2025. The landlord provided the water rates invoice which proves the amount owing at the end of the tenancy was $66.63.

There were three holes in walls or doors; one in the bedroom, one behind the towel rail, and one in a bathroom cabinet door. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.

The landlord provided entry and exit photos. An invoice for $1,405.30 was provided. This was not itemised but included significant effort in stripping wallpaper and repainting the bedroom of what was old wallpaper.

I have taken into account betterment and depreciation. The landlord should be returned to the position they would have been in had the tenant not breached their obligations, and should not be better or worse off. In calculating depreciation, I have taken into account the age and condition of the bedroom wall at the start of the tenancy and its aged condition. I have apportioned $800.00 of the invoice for the costs of repairing the holes. The balance is considered betterment and remains with the landlord.

On 20 August 2025 the Tribunal made an order relating to this tenancy, for rent arrears, bond and filing fee. The previous order is incorporated into this order for enforcement purposes. The bond covered the rent arrears. Filing fee
