The landlord provided rent records which prove the amount owing at the end of the tenancy and that amount is awarded. Cleaning and locks

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.

The tenant cleaned the property but admits that he did not clean the oven properly as he did not have suitable cleaning products. He also noted that the carpets were brand new at the beginning of the tenancy and had not been cleaned at the end of the tenancy. The landlord’s inspection reports notes that the carpets are dirty and there was an unpleasant smell in the property. I am satisfied that the carpets needed cleaning. I am satisfied that the amount charged by the landlord is reasonable for the cleaning of the carpets and the oven, and I award that amount.

The tenant did not return the keys. The landlord had to have new locks installed and the tenant is responsible for the costs of replacing the locks.

The amounts ordered are proved. Holes in the walls

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

Where the damage is careless, and occurs after 27 August 2019, section 49B RTA applies. If the landlord becomes aware of the damage after 27 August, the damage is presumed to have occurred after that date unless the tenant proves otherwise.

The landlord claims $300 for repairs to two small holes at the property. Both holes are behind doors (one in the lounge and the other in the bathroom). The tenant accepts that the holes occurred whilst he was in the property and were caused by the wind catching the doors and pushing them open. He says that the doors were open on windy days where he probably should have put something in front of the door to stop it moving in the wind. There were door stops behind the doors, so I consider that it likely that this damage was more than fair wear and tear and the tenant is liable for the damage.

The landlord only provided a quote, which was dated before the tenancy ended. The landlord says that the work was done, but did not provide an invoice. The Tribunal sees invoices for repair of holes daily, and I consider $300 to repair and paint small holes like these excessive for the work done. I have therefore reduced the amount ordered.

I have taken into account betterment and depreciation. The landlord should be returned to the position they would have been in had the tenant not breached their obligations and should not be better or worse off. In calculating depreciation, I have taken into account the age and condition of the items at the start of the tenancy and their likely useful lifespan. The filing fee

Because [The applicant/s] has substantially succeeded with the claim I have reimbursed the filing fee. Payments by instalments

The tenant accepted that he would have an order made against him that exceeded the bond amount. He wishes to pay the amount ordered against him off in instalments.
