Reasons

The landlord attended the telephone hearing represented by Mr Siebert.
The Tribunal telephoned the tenant, Mr Beasley, who answered the call and confirmed his identity. The call was then disconnected. The Tribunal telephoned him again but the call diverted to voicemail. The Tribunal also called the tenant, Ms Beasley, for the hearing. That call also diverted to voicemail. I am satisfied that the tenants received notice of the hearing and did not attend.
The landlord applied for a possession order after giving the tenants notice that the tenancy would end on the expiry of the fixed term on 23 November 2025. However, the tenants vacated the property and returned the keys to the landlord on 21 October 2025. Therefore, a possession order is no longer required.
The landlord provided a rent record proving the arrears at the end of the tenancy. The tenants stopped paying rent after 17 September 2025 with rent paid up to 23 September 2025. As this was a fixed term tenancy, the tenants are liable for rent to the end of the term or the date of a new tenancy, whichever date first occurs. The landlord provided evidence that the premises were relet from 7 November 2025. Therefore, the tenants are liable for rent owed up to and including 6 November 2025.
The bond is also refunded to the landlord and taken into account.
As the landlord has succeeded with their application, they are entitled to reimbursement of the filing fee.
The landlord filed evidence of post-tenancy cleaning and repairs claims. However, they did not amend their original application to include those claims. As discussed at the hearing, the landlord should file a fresh application for those claims.
