- This is a very unusual tenancy and arrangement whereby the tenant contracts to the landlord and both parties have tolerated incredible deviation from best and standard practice which is to pay rent weekly or fortnightly and in advance.
- The rent summary reflects that rent arrears at times have risen as high as $135,800.00 and rent credit of up to $117,752.00 have been credited at one point.
- Ultimately the parties have consented and maintained this unusual arrangement for over 5 years and it is therefore not for the tribunal to make a judgement about its appropriateness where each of the parties have maintained it to their benefit and detriment for an extended period.
- The landlord provided rent records which prove the amount owing at the end of the tenancy. I am satisfied these records are correct.
- [The tenant/s] tenant/s] stated that he has outstanding invoices with Ashik Homes Limited. The parties should resolve this directly and if there any dispute arises the parties can go to the disputes tribunal.
- Because Ashik Homes Limited has wholly succeeded with the claim I must reimburse the filing fee.
