I am satisfied the tenant was properly served with notice of the hearing to her address for service (the tenancy address). The hearing proceeded without the tenant. The tenant has not provided the landlord with an email address for service.

The landlord has applied for termination for a breach of the tenancy agreement and rent arrears.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. 1

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The landlord provided evidence that then tenant is in breach of clauses 14 and 15 of the tenancy agreement which say:

You must live at the home at all times. The home must only be used by you and the other people who were named in your housing application.

The landlord was advised by another government agency on 5 September 2025 that the tenant is residing at another address. The landlord served a 14 day notice on the tenant on 10 September 2025 and the landlord has attended at the property 14 days thereafter and it appeared the tenant had not returned to live at the premises, in accordance with the tenancy agreement and the 14 day notice. I find on the evidence provided by the landlord that the tenant has breached the tenancy agreement and did not remedy the breach on being served a 14-day notice.
