Reasons
- The landlord attended the hearing. The tenant did not answer either of the calls made to the telephone number provided to the Tribunal, at the scheduled time of the hearing.
- The tenant was served notice of the hearing to an e-mail address that is an address for service on her tenancy agreement. I am satisfied the tenant has been served in accordance with the Residential Tenancy Act, 1986, and she has not sought an adjournment. Because of this I am prepared to conduct the hearing in the tenant’s absence.
- The landlord has applied for termination of the tenancy, rent arrears, refund of the bond and reimbursement of the filing fee.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing up until Sunday 23rd of November 2025, the end of the current rent cycle, is $5,084.76.
- Because Leigh Krall As Trustee For The Leigh Voss Family Trust has wholly succeeded with the claim I must reimburse the filing fee.
