- Both parties attended the hearing which I conducted by phone.
- The application raised a jurisdictional issue: was the tenancy a residential tenancy that falls under the Residential Tenancies Act 1986 (RTA) or was it an excluded tenancy?
- The evidence the parties gave establishes that the tenancy was a residential tenancy; Mr Brown rented self-contained premises separate from the premises Mr Blyth and his flatmates occupied.
- The definition of ‘premises’ in the RTA 1 includes ‘any part of any premises’. There can be separate residential premises as part of the overall premises which was the case with this tenancy. The Tribunal therefore has jurisdiction to determine the application.
- Mr Brown accepted the landlord’s claim for rent. I have made a money order for rent arrears by consent.
- The landlord withdrew the application for a disposal of goods order. Mr Brown’s goods have been returned to him.
- As the application is successful, I have reimbursed the filing fee the landlord paid
- Upon my enquiry, neither party sought an order for name suppression.
