The tenant said he is unsure as to whether that is the correct amount owing but explained some personal difficulties experienced by both tenants recently in relation to receipt of the medical benefit. The tenant indicated that both tenants have mental health issues that require medication and both are on a medical benefit.
As the tenant has not provided any evidence to the contrary about the rent arrears claim made by the landlord, I find it more likely than not that the tenants owe the landlord $3,317.14 in rent arrears to 22 January 2026. Filing fee
Because [The landlord/s] has been successful with the claim I must reimburse the filing fee. Suppression
Both parties requested name suppression. The landlord is entitled to name suppression as they have been successful with the claim. Therefore, I order that the landlord’s name and identifying details and the tenancy address are not to be published. See section 95A(1) RTA.
The evidence was that both tenants are experiencing serious mental health issues that require medication and support. The tenant submitted it would cause more harm than good if their names were to be published. Given the evidence and in the circumstances, I accept this. There is also an ongoing tenancy relationship between the parties. As such, I find the tenants’ interests outweigh the public interest in publishing their names. Therefore, I order that the tenants’ names and identifying details are not to be published.
