The landlord’s representatives attended the hearing by telephone today. I telephoned the tenant however his phone went to voicemail. I continued with the hearing as the tenant has been emailed notice of the hearing date and time to his address for service.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

Rent was 17 weeks in arrears on the date this application was filed.

The Tribunal must make either a final or conditional termination order if rent is at least 21 days in arrears on the date of application or of the hearing. See section 55 Residential Tenancies Act 1986.

I terminated the tenancy on the date of the first hearing which was 9 December 2025.

The landlord seeks payment of rent owing to the date of termination which is $4,576.71.

The tenant has breached his tenancy obligations by failing to pay rent. When one party is in breach, the other party has an obligation to try to reduce or mitigate that loss; see section 49 RTA.

I allowed the landlord and the tenant this second hearing to provide evidence of steps taken to terminate the tenancy or otherwise reduce the loss.

The landlord is a social housing provider and says it tries to keep tenancies going where possible. In May 2025, the tenant told the landlord he had moved elsewhere for work but asked the landlord to keep the tenancy going in the meantime. His last payment of rent was on 23 June 2025.

The first evidence of contact by the landlord with the tenant about rent owing is on 9 September 2025. The landlord made an application to the Tribunal on this date, but this lapsed as additional required information was not provided. The current application was made on 28 October 2025 and the tenancy ended on the first hearing date of 9 December 2025.

After reviewing the oral and written evidence from the landlord, my decision is that the landlord did not take reasonable steps to mitigate its loss. The rent was 11 weeks in arrears by the time the landlord made the first documented attempt to contact the tenant. The lapsing of the first Tribunal application was caused by the landlord. The tenant should not be penalised by having to pay additional rent because of these delays.

I award rent owing to 28 September 2025 which is $2,612.50. This is 13 weeks of rent which allows ample time for a landlord to contact a tenant, make a Tribunal application and wait for a hearing.

A landlord with evidence of abandonment may also apply to the Tribunal under the expedited abandonment provisions which allow for an order to be made terminating the tenancy within 10 working days. See Abandoned premises » Tenancy Services

The landlord’s claim is substantially successful, so I award the filing fee.

I do not suppress either the landlord or tenant names. The landlord is a social housing provider receiving public funding, so the public interest is in transparency of its actions, and this outweighs its interests in privacy. The tenant has breached his tenancy obligations, so the public interest is that his name be published.
