[The landlord’s representative] appeared as the landlord’s representative.

During the hearing, [the landlord’s representative] informed me that Dora Seu is no longer a named tenant. Accordingly, I have removed Dora Seu from this decision.

One of the tenants, Mr. Lima Tofilau, attended the hearing via teleconference. Mr. Lima Tofilau is the elder brother of Mr. Taualai Tofilau, who was at work at the time of the hearing. I attempted to contact Mr. Taualai Tofilau, but the call went unanswered.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

During the hearing, the following repayment plan was agreed upon: a. A lump sum payment of $1,000 towards rent arrears by 27 November 2025. b. The current rent, which falls due every Friday, is to continue being paid as usual. c. An additional instalment of $100 to clear the remaining rent arrears is to be paid on top of the current rent starting from 5 December 2025, until the rent arrears are cleared.
