Should the Tribunal proceed in the tenant’s absence?

The landlords applied for termination of the tenancy on the grounds of abandonment and rent arrears, together with a partial refund of the bond. The landlords advised that a further compensation application may be made once insurance assessments are completed.
The tenant did not attend the Tribunal hearing, which was conducted by video link. A number of attempts were made to contact the tenant using her known contact details, without success. The landlords confirmed the tenant’s email address, which was used by the Registry to serve the notice of hearing. Those details had previously been effective until the tenancy dispute arose. As the tenant was properly served, the Tribunal proceeded in her absence pursuant to section 92(1) of the Residential Tenancies Act 1986.

Should the tenancy be terminated?

Under section 61 of the Residential Tenancies Act 1986, the Tribunal may terminate a tenancy where the premises have been abandoned and rent is in arrears at the date of the hearing. A tenancy is considered abandoned where the tenant leaves the premises without reasonable excuse, does not intend to return or meet their obligations, and fails to notify the landlord.
The evidence establishes that the landlords became aware, or ought reasonably to have become aware, that the premises had been abandoned in late October 2025.
A routine property inspection was scheduled for 26 October 2025, following repeated delays by the tenant. On the day prior, the landlords observed the tenant and her partner at the property, which appeared consistent with removing rubbish. On the inspection date, no one was present and the property appeared largely vacant. Furniture, including a couch and chair, had been left outside the house. Attempts to contact the tenant on both her provided phone numbers were unsuccessful.
The landlords sent several emails seeking contact and offering to reschedule the inspection. During this time, the landlords also discovered that rent due that week had not been paid. A friendly reminder and a formal rent arrears notice were emailed to the tenant. This was the first missed rent payment and was out of character. No response was received.
A further email was sent asking the tenant to confirm whether she had moved out and to return the keys if so. On 29 October 2025, the landlords spoke with the tenant’s grandmother, who advised that the tenant had moved to her father’s property, and was living in a cabin there. The grandmother confirmed that the tenant had moved out, expressed dissatisfaction with the tenant’s conduct, and apparently supported the landlords’ decision to apply to the Tribunal.
The landlords have received no response to emails or phone calls. The tenant and her family have not been seen at the property since Saturday, 30 October 2025. Email correspondence shows communication between the parties regarding a house inspection from 15 October to 21 October 2025, with the tenant’s last email dated 21 October 2025, confirming the inspection for 26 October 2025. No further communication was received after that date.
On the evidence, the Tribunal is satisfied that the premises were abandoned and that rent was in arrears. The tenancy is therefore terminated with immediate effect.

How much does the tenant owe?

The landlords provided rent records confirming the amount outstanding at the end of the tenancy, including rent in lieu of notice. The Tribunal is satisfied that the sum of $800.00 in rent arrears is correctly calculated and payable.
