Ms Iles, representing the landlord, attended the teleconference hearing. The phone number for the tenant, the last three digits being 698, was called twice without any response. As the tenant was served, the hearing proceeded in her absence.

The landlord has applied for rent arrears, compensation, refund of the bond and reimbursement of the filing fee following the end of the tenancy. Burden of proof and evidence

The party making the claim bears the burden of proof on a balance of probabilities, i.e. that it is more likely than not that something occurred.

The issue of evidence at Tenancy Tribunal hearings was considered by the District Court in Kaipo v Clarke & McCarthy (DC) TT233/02. Judge Mather stated: “...[the applicant] needs to be reminded that like anyone who brings an application before a Tribunal or a Court, it is incumbent upon the applicant to provide the evidence necessary to prove the case. If the applicant fails to do that, then their application will be dismissed whether it has merit or not because it is up to the applicant to provide the necessary evidence. It is not up to the other parties and it is certainly not up to the Tribunal to extract evidence.”

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The landlord said the tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. The landlord indicated also that the carpets needed to be cleaned as they were filthy and stained. The landlord provided invoices for carpet cleaning in the amount of $200.00, for cleaning the property in the amount of $373.75 and for rubbish removal and dumping in the amount of $1,167.25.

The landlord said the tenant did not return the keys and so the front door locks had to be changed. The landlord provided an invoice from a locksmith for doing this in the amount of $195.00.

The landlord said there were curtains missing at the end of the tenancy, a blind had to be hung in the lounge and curtain hooks had to be replaced. The landlord provided an invoice in the amount of $184.00 for a handyman to complete these jobs.

Whilst the landlord provided invoices as outlined above, which is evidence of the costs of cleaning, rubbish removal, carpet cleaning, locks that had to be changed and handyman costs, the landlord did not provide any Inspection Reports, noting the issue with keys not being returned, or comments about the state of the property, or photographs of the condition of the property, that might show the requirement for the landlord to incur these costs in the first place at the end of the tenancy.

As such, I find the landlord has provided insufficient additional supporting evidence to prove any of their compensation claims and so dismiss these claims. Filing fee

Because Prestige Property Management Limited As Agent For J Bryant & V Joseph has been partly successful with the claim I reimburse the filing fee. Refund of the bond
