Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

The tenant has given evidence about the severe health conditions and personal complications which have impacted her ability to pay the rent when due.

This is a 5 ½ year tenancy. The property manager confirms that in other respects the tenant is meeting her obligations. For much of the tenancy the rent has been in credit.

The tenant hopes and expects to be able to clear the debt in full once money owed to her which is presently held in a solicitor’s trust account, is released.

In the meantime, she says she can commit to paying the arrears by paying 3 week’s rent every fortnight.

The landlord seeks termination of the tenancy on the basis that the arrears have been ongoing and compromising the owner’s ability to meet their own commitments.

I understand the owner’s concern. However, if this arrangement is sustained. The landlord will have retained a good tenant and will have the arrears repaid within 9 fortnights which is a long but not severely long time. If it is not, the tenancy will immediately terminate.

On balance I find that the grounds are established for making a conditional termination Order as an alternative to ending the tenancy 1 .

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach 2 .

Because Soho Property Management Limited As Agent For The Cui Family Trust has substantially succeeded with the claim I must reimburse the filing fee.
